Imagine One Restructuring Act in Canada

In this article, Vern W. DaRe and Teodora Prpa consider whether harmonizing Canadian insolvency laws would be best achieved by consolidating these statutes into one uniform bankruptcy, insolvency and restructuring regime.

This idea, which focuses on the idea of “harmonization”, was popular in the 1970’s-1980’s but lost interest as governments changed. 

Their article published in the 2021 issue of the Banking and Finance Law Review (6.2 B.F.L.R. 363-392 available on Westlaw and ProQuest), analyzes legal developments in letters of credit, monetary transitions, demand guarantees, solicitors’ liens, bankruptcy and insolvency, cross-border banking, bank supervision, and the globalized governance of finance.
