Emily Duncan




Emily is an Associate in the firm's Condominium Group, which she joined after summering and articling with the firm. She is developing a broad condominium law practice acting as condominium corporate counsel. Emily assists condominium corporations, developers, and property managers with a broad range of governance matters including enforcement matters, by-laws, and review of agreements. Emily is able to quickly identify a client’s wants and needs and is able to provide practical solutions on how to accomplish their goals.

Emily completed her JD at the University of Windsor where she was awarded Top Oralist  in the Lerners Cup for her outstanding advocacy skills. Prior to entering law school, Emily earned her Bachelor of Arts in Global Development Studies from Queen’s University. Emily is proficient in French. In her spare time, she enjoys cheering on the Raptors, outdoor cycling, and meditation.

Defining Terms and the Important Distinction Between Rules and Policies

In Boodram v Peel Standard Condominium Corporation No. 843, the Condominium Authority Tribunal (the "CAT") reviewed the Corporation's ability to make a determination as to whether someone is a visitor or resident, in order to properly apply the Corporation's declaration provision which prohibits a resident from parking in Visitor Parking.

Condominium Law Update: New SCC Decision Confirms the Duty to Act Honestly in Contracts

In C.M. Callow Inc. v Zollinger, 2020 SCC 45, a decision released on December 18, 2020, the Supreme Court of Canada confirmed that parties to a contract must act in good faith and have a duty to act honestly, even when exercising a right of termination in a contract.

On Friday March 27th, 2020, Prime Minister Justin Trudeau announced a new measure to support small businesses and not-for-profits dealing with the economic impacts of the pandemic.
