OVERVIEW

Development

Members of our condominium development practice group represent a number of developers and builders and work closely with their consulting teams, surveyors, architects and property managers at all stages of the condominium development, marketing and sale of units. We assist our clients in:

  • land acquisitions and financing
  • obtaining re-zoning and municipal approvals
  • preparing all condominium disclosure documents and agreements required to market and sell condominium units
  • drafting all documentation required for the establishment and maintenance of condominium corporations
  • attending to the timely registration of condominium projects, including occupancy and final closings

Governance

This specialized practice group acts as corporate counsel to hundreds of condominium corporations in the Greater Toronto Area, and surrounding regions. Our expert lawyers provide legal advice and services with respect to all aspects of the administration and operations of condominiums, including:

  • interpretation and advice on the Condominium Act, and the condominium documents
  • declaration, by-laws and rules review and re-drafting
  • advising and attending at general and special owners’ meetings; including acting as independent chairperson
  • common expense lien collection and power of sale proceedings
  • enforcement of the Act, declarations, by-laws and rules, including court applications and mediation/arbitration proceedings
  • construction litigation, including construction liens and construction deficiencies
  • drafting and negotiating condominium-related documents (common element alteration agreements and reciprocal agreements)
  • assisting with and conciliating Tarion (ONHWP) Claims
  • human rights issues and employment matters
  • first year budget deficit claims
